New Delhi: The Election
Commission (EC) of India has issued a show-cause notice to 21 Aam Aadmi Party
(AAP) legislators who were appointed as Parliamentary Secretaries by the Delhi
government last year, in order to explain the validity of their appointments
via affidavits and relevant documents before April 19.
The
notice, which seeks their response on why they should not be disqualified, was
issued on the basis of a petition filed by Delhi-based advocate Prashant Patel.
The petition alleged that the MLAs occupied offices of profit in violation of
the Constitution of India. The notices were issued after a petition was filed
on June 19, 2016 saying that the posts had come under the category of profit,
and the appointments are hence a violation of norms and illegal.
The
MLAs have to file a written statement or else 'the commission will then proceed
to take further action'.
AAP spokesperson Deepak
Bijwai said: "There is nothing illegal or improper about the appointments.
This notice is based on a complaint and replies will be filed with full details
within the time-frame."
Ajay Maken, President
of Delhi Pradesh Congress Committee (DPCC) has demanded that Arvind Kejriwal
should take responsibility for the illegal appointments and must resign as the
Delhi CM over the issue. DPCC said that it brought the issue several times as
"violation of not just set norms but also precedent".
The list includes
prominent AAP legislators such as Dwarka MLA Adarsh Shastri, Rajouri Garden MLA
Jarnail Singh, Chandni Chowk MLA Alka Lamba, Rohtas Nagar MLA Sarita Singh,
among others.
